1. Acceptance of Terms

By accessing or using the website located at www.dkconsultinggroupofny.com ("the Site"), or by engaging with any digital marketing services offered by DK Consulting Group of NY ("Company," "we," "us," or "our"), you ("Client" or "you") agree to be bound by these Terms and Conditions. If you do not agree to these Terms, please do not use our Site or services.


2. Services Provided

DK Consulting Group of NY provides digital marketing consulting services including, but not limited to:

  • Google Business Profile (GBP) setup, optimization, and ongoing management
  • Local SEO strategy and implementation
  • Website design and on-site SEO
  • Google Ads and Facebook Ads campaign management
  • Google Analytics setup and reporting
  • Citation building and off-site SEO


Service scope, deliverables, and pricing are outlined in a separate Service Agreement or proposal provided to each client prior to engagement. These Terms and Conditions apply in addition to any such agreement.


3. No Guarantee of Results

Digital marketing, SEO, and advertising involve inherently variable outcomes. While we apply proven strategies and industry best practices, we cannot and do not guarantee specific rankings, traffic levels, lead volumes, revenue outcomes, or advertising performance. Search engine algorithms, platform policies, and competitive landscapes are subject to change at any time without notice.

Results described in case studies or testimonials on our Site represent past client experiences and are not a guarantee of future outcomes for any other client.


4. Client Responsibilities

To enable us to perform services effectively, you agree to:

  • Provide accurate, complete, and timely information required for service delivery
  • Grant necessary access to Google Business Profile, Google Ads, Facebook Business Manager, website platforms, or analytics accounts as required
  • Respond to reasonable communications and approval requests within 5 business days
  • Ensure that all content, logos, photos, and materials you provide are owned by you or that you have the right to use them commercially
  • Comply with all applicable laws and platform terms of service


Delays caused by failure to fulfill these responsibilities may affect timelines and outcomes. We are not liable for any impact resulting from such delays.


5. Payment Terms

Payment terms, rates, and billing schedules are defined in the individual Service Agreement or invoice provided to each client. Unless otherwise agreed in writing:

  • Invoices are due upon receipt or as specified in the agreement
  • We accept payment via Stripe, PayPal, Zelle, check, and other methods as arranged
  • Services may be paused or terminated for non-payment after reasonable notice
  • All fees paid are non-refundable unless otherwise specified in your Service Agreement


6. Intellectual Property

All content on this Site — including text, graphics, logos, images, and code — is the property of DK Consulting Group of NY or its content suppliers and is protected by applicable copyright and intellectual property laws.

Upon full payment for services, any deliverables created exclusively for you (such as website content, ad copy, or GBP assets) become your property. We retain the right to reference your project in our portfolio and case studies unless you request otherwise in writing.

We do not claim ownership over your pre-existing brand assets, logos, or business information provided to us.


7. Third-Party Platforms

Our services involve working within third-party platforms including Google, Meta (Facebook), and others. These platforms have their own terms of service and policies, which are subject to change. We are not responsible for:

  • Policy changes made by Google, Meta, or any other platform
  • Account suspensions, disapprovals, or restrictions imposed by third-party platforms
  • Interruptions to platform services outside our control


We will make reasonable efforts to notify you of significant platform changes that affect your campaigns or profiles.


8. Limitation of Liability

To the maximum extent permitted by applicable law, DK Consulting Group of NY and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of business, loss of data, or loss of goodwill, arising from or related to your use of our services or this Site.

Our total liability for any claim arising from our services shall not exceed the total fees paid by you in the three (3) months preceding the claim.


9. Indemnification

You agree to indemnify and hold harmless DK Consulting Group of NY, its owners, employees, and contractors from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) any content or materials you provide to us; or (d) your infringement of any third-party rights.


10. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive business information shared during the course of the engagement. This includes but is not limited to business strategies, client lists, campaign data, and pricing. This obligation survives termination of services.


11. Termination

Either party may terminate services with written notice as specified in the applicable Service Agreement. Upon termination:

  • You will be invoiced for all work completed through the termination date
  • We will return or transfer access to your accounts and assets within 10 business days
  • Any outstanding balances become immediately due


12. Governing Law

These Terms and Conditions are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Kings County (Brooklyn), New York.


13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
